The KCPOG has settled
the Unfair Labor Practice Charge it filed against King County
related to the cancellation of the June, 2007 test by the Human
Resources Director. The substantive terms of the settlement allow
most employees who took either test to use their score for Sergeant
eligibility. If the employees took both tests, their best overall
score will be used. The specific language of the settlement is as
follows:
King County and the Guild agree
that if a candidate took the June 2007 sergeant's examination and
the January 2008 sergeant's examination, the better of their two
passing assessment center scores will be used to create a final
eligibility list of sergeant's candidates (the "final eligibility
list"). If a candidate took the June 2007 sergeant's examination
and did not take the December 2007 written examination (and also did
not proceed to the January 2008 assessment center), the candidate's
passing assessment center score for the June 2007 sergeant's
examination will be used for the final eligibility list. If the
candidate took the June 2007 examination and took the December 2007
written examination but did not score 70 or above that candidate's
name will not be placed on the final eligibility list. If a
candidate only took the January 2008 sergeant's examination but did
not take the June 2007 sergeant's examination, the candidate's
January 2008 passing assessment center score will be included in the
final eligibility list.
This
settlement leaves open the legal issue as to whether the County can
usurp civil service functions that should be administered by a civil
service commission.
