CALLED TO ORDER:

The Board of Directors Meeting was called to order at 1602 hrs by President Steve Eggert.

APPROVAL OF MEETING MINUTES:

The minutes from the October 10, 2007 Board of Directors Meeting have been posted at worksites and on the website.  They were distributed again for review.  A motion was made by Pat Bowen to approve the minutes as submitted.  The motion was seconded by Mark Lemoine.  Motion passed.

APPROVAL OF INCOME AND EXPENSE REPORT:

Ron Kierce presented the October 2007 Income and Expense Report.  The report was reviewed and discussed.  A motion was made by Mark Lemoine to approve the report.  The motion was seconded by Don Dougherty.  Motion passed.

24 HOUR SHIFT SCHEDULE FOR ARFF UNIT:

Representative Kirk Wills from the ARFF Unit presented the Board with a proposal from Captain Jerrell Wills on a 24 hour shift schedule for the unit.  Steve Eggert has not had the opportunity to review the County’s proposal in any detail but informed the membership that the issue is clearly a subject of bargaining.  Steve reminded everyone that the proposal was a first draft of what will most likely look much different should a final agreement be reached on any implementation of a 24 hour work schedule.  Steve will be speaking with members of the ARFF unit for further details on their job duties and responsibilities before answering the County’s proposal for a 24 hr shift schedule.

SERGEANT’S EXAM:

As many of you are aware, the KCSO has decided to proceed and administer another Sergeant’s Exam in spite of a current Unfair Labor Practice complaint pending with PERC (Public Employment Relations Commission).  The job announcement is out and the testing schedule published.  The King County Police Officers Guild has filed an addendum to the current Unfair Labor Practice to include a failure to bargain over new changes in the upcoming Sergeant’s Exam.  The Guild has considered filing an injunction to stop the new Sergeant’s Exam, but has been advised by the Guild attorneys that an injunction is highly unlikely to be approved by a judge and can be quite costly.   KCPOG also examined the possibility that PERC would file an injunction themselves over the issue and found that as long substantial injury would not be incurred to both parties, and that a remedy is likely, they would not consider an injunction.    There has been past cases similar to this in which PERC has found a remedy.  Most likely, if the KCPOG were to prevail, any Sergeants promoted from the new list would be demoted and the old list reinstated.  Other remedies may include retaining Sergeant Pay grade for those being demoted until the next exam cycle along with other potential remedies.

Members interested in taking promotional tests should proceed with the new test, but be aware that there is a potential to demotion or other as yet unknown remedy should they be promoted.

CHANGE IN INTERPRETATION OF PORTAL TO PORTAL, OFF DUTY VS. ON DUTY:

There is much talk as of late concerning KCSO’s decision to inform Labor and Industries of Deputy Donn Potteiger’s on duty/off duty status when he was struck by a vehicle after working a special emphasis for the Torchlite Parade.    First, the KCPOG feels it is clear that Donn’s overtime was subject to the Portal to Portal provision in the Collective Bargaining Agreement.  Second, Donn has informed various people that he on his way to the Precinct to submit his overtime because of a three day furlough that was to follow.  This practice is clearly mandated by KCSO, after the Covey overtime lawsuit.

KCPOG has also heard talk that the KCSO has taken a stance that Deputies are “Off Duty” as soon as their shift has ended, even if they are driving the employer’s vehicle home and are required to perform a law enforcement function if the need arose.  Members should be aware that King County is self insured and would at least cover medical costs involving a department issued vehicle.  Pat Bowen is working with KCSO in an effort to define what policy direction is in fact taking place.  Updates will follow.

NEW TIME FOR BOD MEETINGS:

Mark Rorvik proposed moving the Board of Directors Meetings to coincide with the new meeting times of the General Membership Meetings, which is now on a trial basis of 1400 hrs.  To be short, Mark had no support for his hair brained idea.  The BOD told Mark to continue crying over spilled milk and the issue quickly died.  Hopefully you realize I’m being light at Mark’s expense.   The Board reasoned that having different start  times for the two meetings would allow more opportunity for members to attend a meeting.

WEB PAGE DESIGN:

Marcus Williams has been exploring the possibility of using Unions America to service our website.  Unions America provides web site services to hundreds of Union throughout the United States and provides a host of additional services that the current KCPOG web page does not.  Marcus will continue to explore the details and cost.  KCPOG will also invite our current Web Page administrator to December’s BOD/GMM to see what ideas and suggestions he may have on improving the website.
